Below you will find our General Terms and Conditions (effective date: May 1, 2024). These always apply when you use or place an order through our website. The "General Terms and Conditions" contain important information for you as a buyer. Therefore, please read them carefully. Article 2: Definitions

In these conditions the following definitions apply:

  1. Supplier: Gray Courts, the sole proprietorship that offers products to buyers in its webshop.
  2. Buyer: the natural person or legal entity who enters into a (distance) agreement with Gray Courts or the natural person who does not act in the exercise of a profession or business who enters into a (distance) agreement with Gray Courts.
  3. (Distance) agreement: an agreement in which, in the context of a system organized by Gray Courts for (distance) sales of products and/or services, up to and including the conclusion of the agreement, exclusive use is made of one or more techniques for communication (remote).
  4. Remote communication technology: means that can be used to conclude an agreement, without the consumer and entrepreneur being together in the same room at the same time.
  5. Services and/or products: the subject of one or more agreements.

Article 3: Applicability

  1. These are the general terms and conditions of Gray Courts. These general terms and conditions apply to all orders placed via the Gray Courts website.
  2. By placing an order, the buyer explicitly agrees to the applicability of these general terms and conditions to the order placed by the buyer and the buyer declares that he is familiar with the content thereof.
  3. One or more provisions in these general terms and conditions may only be deviated from if this has been expressly agreed in writing by Gray Courts. In that case, the other provisions of these conditions remain in full force.
  4. If the buyer applies general terms and conditions, these are expressly rejected unless agreed to in writing by Gray Courts.
  5. Unless otherwise agreed in writing, the general or specific terms and conditions or stipulations of third parties are not recognized by Gray Courts.
  6. The text of these general terms and conditions will be made available to the buyer electronically by Gray Courts in such a way that it can be easily stored on a durable data carrier.
  7. Before the (distance) agreement is concluded, the text of these general terms and conditions will be made available to the buyer. If this is not reasonably possible, before the (distance) agreement is concluded, it will be indicated that the general terms and conditions can be viewed at Gray Courts and where the general terms and conditions can be viewed electronically and that they can be updated at the request of the buyer. will be sent free of charge electronically or otherwise.
  8. Gray Courts reserves the right to change and/or supplement the general terms and conditions at any time.

Article 4: The offer and conclusion of agreements

  1. By using the Gray Courts webshop and/or placing an order, the buyer accepts these general terms and conditions as well as all other rights and obligations as stated in the webshop and applicable in the webshop.
  2. Gray Courts is authorized to use third parties in the execution of an agreement with the buyer.
  3. Gray Courts' offer is without obligation unless a term for acceptance is stated in the offer.
  4. Offers are valid while stocks last.
  5. If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated in the offer.
  6. The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable a proper assessment of the offer by the buyer. If Gray Courts uses images, these are a true representation of the products and/or services offered. Obvious mistakes or errors in the offer do not bind Gray Courts.
  7. Each offer contains such information that it is clear to the buyer what the rights and obligations are associated with acceptance of the offer.
  8. The agreement is concluded when you place an order via the website and Gray Courts has sent a confirmation of your order by e-mail.
  9. Gray Courts takes appropriate technical and organizational measures to secure the electronic transfer of data and ensures a safe web environment. If the buyer pays electronically, Gray Courts will take appropriate security measures.
  10. Gray Courts can - within legal frameworks - inform itself whether the buyer can meet his payment obligations, as well as all those facts and factors that are important for a responsible conclusion of the agreement (remotely). If, based on this investigation, Gray Courts has good reasons not to enter into the agreement, Gray Courts is entitled to refuse an order or request with reasons or to attach special conditions to the execution.
  11. Gray Courts reserves the right not to accept your order in the event:
  • The information entered by the buyer is not correct or complete and in the event that Gray Courts doubts its accuracy;
  • Buyer has not fulfilled a previous payment obligation;
  • Buyer has not received and/or has not collected previous orders;
  • The delivery address specified by the buyer is located in a country where Gray Courts does not deliver.

12. Gray Courts will inform the buyer as soon as possible if the order is not accepted.

Article 5: Prices and payment

  1. The price displayed on the website at the time of payment is a total price of all products, excluding shipping costs and including taxes applicable in the European Union, unless otherwise stated by Gray Courts.
  2. The buyer owes the price that Gray Courts communicated to it in its confirmation. Obvious (manipulation) errors in the quotation, such as obvious inaccuracies, can also be corrected by Gray Courts after the agreement has been concluded.
  3. Shipping costs are not included in the price. Special rates apply for shipping outside the Netherlands. Certain payment methods are subject to further conditions regarding the shipping method and associated costs. This will be clearly communicated to the buyer.
  4. If prices for the products and services offered increase in the period between the order and its execution, the buyer can cancel the order or terminate the agreement within ten days after notification of the price increase by Gray Courts
  5. Orders via the webshop can be paid via the following payment options:
  6. iDEAL;
  7. PayPal;
  8. American Express;
  9. VISA;
  10. MasterCard.
  11. Gray Courts may expand payment options in the future. Other payment options will be announced via the website.
  12. The buyer has the obligation to immediately report any inaccuracies in payment details provided or stated to Gray Courts.
  13. In the event of non-payment or late payment by the buyer, the buyer owes interest on the outstanding amount, calculated from the day on which payment should have been made until the day of full payment, whereby an commenced month is counted as a full month.
  14. The buyer will also be charged for all (extra)judicial costs of whatever nature that Gray Courts has had to incur as a result of the buyer's failure to fulfill its (payment) obligations.
  15. In the event of late payment, Gray Courts is entitled to terminate the agreement with immediate effect or to suspend (further) delivery until the buyer has fully fulfilled his payment obligations, including the payment of interest and costs due.
  16. Orders delivered outside the European Union may be subject to additional fees and/or taxes. These surcharges and/or taxes are expressly not included in the total price stated in this article. Any additional costs arising from these surcharges and/or taxes are at the buyer's own expense and risk.

Article 6: Sales area
Orders can only be delivered within the EU.

Article 7: Delivery

  1. Gray Courts makes every effort to process and deliver your order as quickly as possible, but in any case within 30 days of the purchase date. In principle, Gray Courts strives to ship orders placed before 3 p.m. on a working day within 2 days. The delivery deadline is 30 days after receipt of the order. The delivery date is also subject to change if you make changes to your order.
  2. The buyer is obliged to do everything that can reasonably be expected of it to enable Gray Courts to deliver the order on time. If the buyer does not cooperate, Gray Courts reserves the right not to deliver the products.
  3. The order will be delivered to the delivery address or collection point indicated by the buyer on the Gray Courts website.
  4. Gray Courts' delivery obligation will, unless proven otherwise, be fulfilled as soon as the goods delivered by Gray Courts have been offered to the customer. In the case of home delivery, the carrier's report, containing the refusal of acceptance, serves as full proof of the offer of delivery.
  5. Gray Courts may provide further information regarding delivery times on the website or otherwise make it known in writing. All terms stated on the website are indicative. Therefore, no rights can be derived from the stated periods.
  6. Gray Courts strives to report delays to the buyer by telephone or email within one working day.
  7. As soon as the products to be delivered have been delivered to the specified delivery address, the risk as regards these products passes to the buyer.
  8. Different conditions may apply to deliveries abroad.
  9. If the delivery is made in parts, Gray Courts has the right to regard each delivery as a separate transaction.
  10. Gray Courts makes every effort to deliver the products ordered by the buyer complete and in good condition. If the delivered products are incomplete or damaged, the buyer must notify this within 48 hours of receipt of the order.

Article 8: Faithful representation and longevity

  1. Gray Courts does its utmost to represent the products on its website as faithfully as possible. If the buyer is of the opinion that the ordered product does not correspond to the representation on the website - at the time of ordering the product - then the buyer can exercise your right of withdrawal. Article 9 of these general terms and conditions describes how the buyer can exercise the right of withdrawal.
  2. The lifespan of the products that Gray Courts offers on its website depends on the material of the product and the way and intensity with which the buyer uses the product. To ensure that the products maintain their optimal lifespan and quality, it is important that the buyer observes the (washing) instructions.

Article 9: Reflection period, right of withdrawal and exchange

  1. If the buyer is not satisfied with the ordered product(s), the buyer can terminate the agreement within a cooling-off period of 14 days after receipt of the product in question without giving reasons (right of withdrawal).
  2. The reflection period starts on the day after the buyer has received the product or on the day that a third party designated by the buyer (this is not the carrier) has received the product.
  3. The buyer has the right to terminate the agreement within 14 days. In this case, the buyer must return the product(s) as soon as possible, but in any case within 14 days from the day on which the buyer has exercised the right of withdrawal. The product(s) in question can be sent to the product return address mentioned in Article 1.
  4. The buyer is only liable for any reduction in value of the goods due to processing other than what is necessary to assess the nature, properties and function of the goods. This means that all items must be returned in the same condition as when received; the items must not be damaged, dirty, washed, altered or worn (other than for trying on) and all tags or tags must be intact.
  5. If a product is eligible for a refund, Gray Courts will refund the amount paid for the product to the account number used by the buyer within 14 days of receipt of the product in question.
  6. When returning a product(s), the buyer will receive a refund of the total purchase amount. Shipping costs will not be reimbursed.
  7. When exchanging a product(s), the buyer will receive the desired product(s) and, if applicable, the amount of difference between the exchanged and the desired product(s).

Article 10: Defects and complaints

  1. The buyer is obliged to carefully inspect the products immediately upon receipt.
  2. Complaints from the buyer relating to defects in the product or the delivery, which are externally observable, must be submitted by the buyer to Gray within 7 days after delivery (or within 7 days after the invoice date if the products could not be delivered to the buyer). Courts are notified.
  3. Gray Courts does its utmost to ensure that the ordering and delivery process runs smoothly. If there is still a complaint, the buyer can contact us via our contact details as stated in article 1 of the general terms and conditions.

Article 11: Retention of title

  1. Ownership of products, notwithstanding actual delivery, will only be transferred to the buyer after he has fully paid all that he owes under any agreement with Gray Courts. This also includes the reimbursement of interest and costs, also for earlier or later deliveries and any work performed or to be performed with regard to the products.
  2. The buyer may not tax, sell, resell, alienate or otherwise encumber the products before ownership has been transferred.

Article 12: Warranty and liability

  1. In principle, the warranty applies to products supplied by Gray Courts, as determined by the manufacturer of the relevant item. If the delivered item does not comply with the agreement, the buyer must notify Gray Court of this within a period of two months after discovery. Natural persons who do not act in the exercise of a profession or business who have entered into a (distance) agreement with Gray Court are entitled to the rights as set out in the Civil Code, Book 7, Title 1, Sections 1 - 7.
  2. Gray Court is never obliged to pay any compensation to the buyer or others, unless there is intent or gross negligence on its part.
  3. Gray Court accepts no liability for consequential or business damage, indirect damage and loss of profit or turnover.
  4. If Gray Court is obliged to compensate any damage for whatever reason, then that compensation will never exceed an amount equal to the invoice value with regard to the product or service that caused the damage.
  5. Without prejudice to the provisions of this article, there can be no warranty in the following cases:
  6. If the wear and tear can be considered normal;
  7. If changes have been made in or to the product, including repairs that have not been carried out with the permission of the manufacturer;
  8. If the original invoice cannot be submitted, has been changed or made illegible;
  9. If defects are the result of improper use or improper use;
  10. If damage is caused by intent, gross negligence or negligent maintenance.

Article 13: Force majeure

  1. In the event of force majeure, Gray Courts is not obliged to fulfill its obligations towards the buyer. Gray Courts is entitled to suspend its obligations for the duration of the force majeure.
  2. Force majeure means any circumstance beyond its control that prevents the fulfillment of its obligations towards the buyer in whole or in part. These circumstances include strikes, fire, business disruptions, energy disruptions, disruptions in a (telecommunications) network or connection or communication systems used and/or the unavailability of the internet site at any time and non-delivery or late delivery from suppliers or other engaged third parties.

Article 14: Personal data

  1. Gray Courts will only process the buyer's data in accordance with its privacy policy.
  2. Gray Courts complies with applicable Dutch laws and regulations.

Article 15: Disputes

  1. Agreements between Gray Courts and the buyer to which these general terms and conditions apply are exclusively governed by Dutch law.
  2. The parties will first make every effort to settle a dispute by mutual agreement.
  3. Disputes arising from an agreement between Gray Courts and the buyer, which cannot be resolved by mutual agreement, will be dealt with by the competent court within the district of the Limburg court, unless Gray Courts prefers to refer the dispute to the competent court of the place of residence of the buyer, and with the exception of those disputes that fall within the jurisdiction of the subdistrict court.

Article 16: Other provisions

  1. Gray Courts aims to respond to emails sent to info@graycourts.com within 48 hours.
  2. You must report any inaccuracies in the information provided to you by Gray Courts to Gray Courts within 24 hours, as well as any changes or inaccuracies in the information you have provided to Gray Courts.
